Satisfaction guaranteed or your money back

We pay lots of attention to the creation and the production of our products, and in the fulfilment of your order as well.

However, if one of our products should ever fail to give you complete satisfaction, we commit to refunding or exchanging any product returned to us in its original packaging within seven days of its delivery. This policy complies with current regulations and the present terms of sale.

Refund policy

Customers have seven business days to return, at their expense, products that they no longer wish to keep, no questions asked. This period begins on the day the ordered product has been delivered.

If a customer wishes to exercise his right to a refund, he can choose between a refund of his order and an exchange of the product for an identical one if it is still available from the seller.

The customer must formulate his request by registered mail (with acknowledgement of receipt) along with his bank account details; also, the customer must return the product(s) in the original packaging and in perfect condition, at his expense, to the following address:

In the event of a refund, ARTFACT'PARIS commits to reimbursing the customer no later than 30 days after the date on which this right was exercised.

The customer can choose to receive his refund by bank transfer or by postal transfer, addressed to the customer who placed the order.

In accordance with article L. 120-20-2, 1 of the Consumer Code, "the right to a refund cannot be exercised for video or audio recordings or for computer software opened by the customer, and this also holds true for newspapers, periodicals and magazines."

Flexible delivery methods

Shipping fees charged by FEDEX and the French post office are calculated according to the weight of the shipment and the delivery zone. No matter what delivery formula is chosen, packages are handed over to the recipient in person.

For deliveries to metropolitan France and Monaco

Deliveries usually take up to 48 hours.

For deliveries in Europe

For the following countries: Austria, Belgium, Denmark, Finland, Germany, Ireland, Italy, Luxembourg, Netherlands, Norway, Portugal, Spain, Sweden, United Kingdom
Deliveries usually take between 3 to 5 days

For other destinations

Please note that, with the exception of public holidays:
Orders placed Monday morning through Thursday night are processed the next day.
Orders placed Friday morning through Sunday night are processed the following Monday; the 48 hour order processing period begins on the Monday morning.

For fragile, bulky and expensive objects, a specialised transporter will handle the delivery.

We use the Paypal secure payment solution, which uses the SSL (Secure Socket Layers) system to encrypt information when it is transferred between your computer and the payment server.

Your bank account info is therefore safe, since the payment approval codes issued by the banks are the only items that are retained.

Your personal information is kept confidential

The personal information that we request from you is only used for the processing of your order and for the improvement of our services.

If you wish to receive news about the artists or the online shop (new items, promotional offers), your email address will be included in the website's mailing list. We commit to removing your address from this list as soon as you request it.

You may occasionally receive offers from ARTFACT'PARIS' partners (galleries, museums, artists). If you do not want to receive such offers, just let us know.

- product category (artistic products, limited editions, accessories)

Artist rights

In exchange for their creative efforts, artists retain rights to their works, as defined by French laws. Representation and duplication rights for works displayed on the artfactparis.com website belong to both the works' creators and ARTFACT'PARIS. Their joint authorisation is required in order to exercise either of these rights. Your rights regarding purchased artwork are therefore limited to private use, and exclude both representation and duplication rights. 

Intellectual property rights

All items displayed on the website, and the website itself, are protected by copyrights, trademarks, design and model rights and/or any other intellectual property rights. Items include but are not limited to the following: photographs, drawings, illustrations, texts, videos, logos, brands, models, software, etc... These items belong to the ARTFACT'PARIS company or are used with the permission of their owners. In this respect, any reproduction, representation, usage, adaptation, modification, incorporation, translation, sale, partial or whole in any way, shape or form (paper, digital, etc...) is strictly forbidden without the express written consent of ARTFACT'PARIS, except for cases covered by article L.122.5 of the Intellectual Property Code. Unauthorised usage may be deemed a copyright infringement and/or a violation of designs and models and/or brands, punishable by two years imprisonment and a 152,449.02 euro fine.

Contractual documents

The contract is created by the following contractual documents:
- the present general terms of sale
- the order form, which is comprised of the accepted quote and is completed by the information required to identify the Customer (surname, first name, billing and/or delivery address, telephone, email address) as well as the Customer's bank account details.

Order placement

Any order form validated by the Customer constitutes an irrevocable acceptance which cannot be reversed except in those limited cases brought forth in the present general sales terms in the "Refund policy" and "Order fulfilment" sections.

Confirmation by email

The following contractual information will be subject to a confirmation email to be sent no later than the delivery date:
- the individual order number
- the total amount of the order
- the Customer's chosen delivery method
- the Customer's chosen payment method

Refund policy

Customers have seven business days to return, at their expense, products that they no longer wish to keep, no questions asked. This period begins on the day the ordered product has been delivered.

If a customer wishes to exercise his right to a refund, he can choose between a refund of his order and an exchange of the product for an identical one if it is still available from the seller.

Order fulfilment

Orders are processed within the 30 days following the Customer's order validation.

Despite ARTFACT'PARIS' efforts to keep its website up to date, a product may become unavailable between the time the order is taken and the delivery date. In the event that the product is not available, the Customer will be informed of this as soon as possible and his order will be cancelled. The Customer will be reimbursed within the 30 days following the cancellation.

Delivery

Delivery can only take place once the order has been validated by the Customer and paid for, unless otherwise specified in the order form (basket). Banking payment centres will therefore have already given their payment approval. In the event that a payment centre denies payment, the order will automatically be cancelled. Furthermore, ARTFACT'PARIS reserves the right to refuse an order if there is currently a dispute or lawsuit underway with a customer. 

Products are delivered to the address listed on the Customer's order form. The Customer commits to receiving the ordered products. In the event that the Customer is absent during a delivery, a delivery attempt notice will indicate where the package may be picked up or will provide the option for a second delivery to be made (at the Customer's expense).

If no response is made to the delivery attempt notice, the package will be returned to ARTFACT'PARIS and the Customer will be reimbursed, minus delivery costs.

For fragile, bulky and/or expensive objects:

In the event that the Customer is absent during a delivery, additional costs incurred by a second visit are fully at the Customer's expense.

At the time of delivery, the Customer should verify the condition of both the packaging and the actual merchandise. In the event that the delivered product is defective or does not conform to specifications, the Customer must inform the Customer Service department, which commits to solving the problem as soon as possible.

Customs taxes and duties

The recipient of your order may have to pay customs duties in order to recover the merchandise. The payment of taxes (VAT) may also be required.

The amount of any applicable customs duties and taxes depends on the country, the nature and the origin of your package.

Price

Prices are listed in sterling (incl. taxes), excluding packaging and delivery fees.
Prices that apply to the sales contract are those that are in effect at the time of the order, and which are listed in the confirmation email. They take into account the VAT that is applicable on the day of the order. Any modification of the VAT rate will automatically be applied to the prices.

For deliveries outside of the European Union, customs taxes and formalities are the Customer's entire responsibility (except when noted otherwise in the order form). The Customer commits to checking into the possibilities of importing products into his country. 

Payment methods

By credit card

Validation of the order using a credit card number and its expiration date warrants the full payment of the order.
The following credit cards are accepted: Carte Bleue, VISA, Mastercard, American Express, Maestro and Discovery.
Information pertaining to the credit card is only kept during the processing of the order.

Personal information

Information that is requested from the Customer is necessary to process his order, and it might be shared with ARTFACT'PARIS' contractual partners who intervene in the processing of the order.

In accordance with the French "IT and Freedom" law of 6 January 1978, Customers who may be opposed to such sharing of information have a right to access, modify, correct and remove personal information that concerns them. Encryption

ARTFACT'PARIS guarantees that the encryption methods and services that it uses to secure transactions have been subject to either an authorisation or a declaration in accord with currently applicable legislation.

Electronic signature

Validation of the order form, when combined with the message authentication and integrity protection steps, constitutes an electronic signature which bears the same validity between the parties as a handwritten signature.

Digital records, which are held in ARTFACT'PARIS' IT systems that feature reasonably secure conditions, are considered as proof of communications, orders and payments that took place between the parties.

The archiving of order forms and invoices is done on reliable and irreversible media in such a way that it represents a genuine and long-lasting copy, in accordance with article 1348 of the civil code. 

Validity of the entire contract

If, for one reason or another, one of the present general terms of sale was to be declared void, this would not affect the validity of the other clauses of the general terms. The voided clause would then be replaced with a measure that is as similar as possible.

Responsibility

Neither ARTFACT'PARIS nor the Customer can be held responsible for any nonfulfilment which may originate from an instance of force majeure that is beyond their control. This includes, but is not limited to, instances of war, riots, insurrection, transport interruptions, importation or exportation problems, strikes, lockouts, shortages, fire, earthquakes, storms or flooding. Similarly, ARTFACT'PARIS cannot be held responsible for the manner in which the ordered and delivered products are used. The Customer is solely responsible for his, or a third party's, usage of the products.

Dispute settlement

The contract is subject to French law.
Any litigation will be handled within courts located in Paris.
